Grey's question

So can someone explain how a thief stole from me, went grey, then attacked me without me being able to call the guards. Then after i come back to life he kills me again and i still cant call the guards on him. shouldnt there be a way to protect yourself in town at least?

Did you attack him after he stole from you?
