I attacked a dude became criminal

He left. Came back about 2 minutes later and decides to attack back in town.

My char auto attacks back and i become a criminal....
Guards come , own me.. Loose my stuff (i dont care about my stuff)

you forgot to tab out in those two minutes, he mearly walked up to you and you were still "in combat" with him. You then punched him in the face.
