I'm just going to go right on ahead here and point out the following:

1 - Downs posted the terms of the agreement including statements purporting what effyou had agreed to.
2 - Effyou did not make any representation purporting to assent to the terms which Downs had stated.
3 - Effyou did not imply that he had negotiated or agreed to the terms until after the trade had gone ahead.

As we can see, there was no proof of agreement between the two parties until after the transfer took place.

If Effyou did scam Downs, and then Downs tried to rely on this forum before the time that effyou had given proof that he in fact did agree to the terms, then Downs could not rely on the forum post to get effyou banned from the trade forums.

The reasoning is this: Downs cannot unilaterally post the terms without assent from effyou as proof that they are the agreed terms, and then rely on such terms, until effyou publicly states on the trade forums that he has agreed - or alternatively, there is some evidence in IRC or perhaps screenshots that suggest effyou has assented to the particular terms on the forum. For instance if on IRC effyou said "I see you've made a forum post, good, now you have protection in case I scam you."

Otherwise, I could just as easily set up a deal in-game with Kith, for instance, and post the terms on the forum, without Kith knowing that the forum post is there. Subsequently, Kith is actually intended to scam me, not knowing about the forum post and upon scamming me gets banned from the forums. It would be grossly unjust to impose the protections of the trade forum on an era-accurate scam on a scammer who has not actually agreed to be bound by the protections for buyers on the forums.

Let this stand for future reference and as a warning to buyers to ensure that the "seller" publicly agrees to the deal on the forum post before the transfer takes place.

There was no need on my end for him to confirm, as he transferred the house first. I had 0 risk in the transaction. He wanted my forum account on the line since i was the one that was in the position to screw him over. If he was expecting my deeds first, then was gonna transfer the house, ya I would have made him post it.

From the information that was posted in this thread, had I scammed effyou, he would have sufficient proof to have my forum account banned, so this thread was a raging success full of good information.

This thread needs not bring anymore drama than what has already been deleted...less you wish to have your trade forum privileges revoked I suggest canning it.
