Losing Karma killing perma grays

Hail Citizens!,
I have noticed I have been losing karma killing players that are perma gray. I did some looking around about this subject but have yet to come across any information that pertains to my question.
Seeing as how since they are perma gray, criminal, and have lower karma than me; should I be gaining karma instead of losing it?
