I was herding, not afk and was flagged criminal

How did this happen? I was herding in Brit when Son gates in, he kills another blue to the south of me then focuses his attack on me. I immediately call guards and get myself whacked. For some reason I was flagged grey and I was guardwhacked instead of him who was also grey.
Here is the screenshot of my journal afterward.

You can see the corpse to the south of the other player who fell victim.
Here is a screen shot after to see me continuing to herd. Right after I call guards then "Whack!"

Yeah that's why it says son IN NOX right before I flagged grey for some unknown reason. I was using the same macro to the skill point shown without incident...herding is not an aggressive act. Click on the picture to enlarge it in detail.

You never aggro but killed the other dudes...whatever.

I guess it fits in your liar, scammer profile.

you can see in your own journal log "you've committed a criminal act" so thats why you got guard whacked. dont know what you did but you did something.

Thats what I was talking about, then he came in all insulting me and lying.
I know there is a trick where you aggro on someone then come back once you are blue to have them aggro on you so you won't be flagged.
I just want to know if that's what happened. I really don't care that it happened, I just want to know how.

Look at my crime time in the first picture...29 seconds and this was taken after I was dead, I was at this for hours mind you. I wasn't afk but I was in and out of messenger during this time. (That's why the last pic is cropped.)

What happened is all I am asking, I dont understand how I was the one who got flagged. Having the crimetime so fresh it was at the time of my death raises some questions being I was there for literally hours without a problem. This wasnt the first character I used this macro with either.

There is no way to become a criminal ia herding, I just reviewed all posibilities there.

I suspect you auto defended against him when he was blue. I am looking into this to see how this happens.

The guy is royally confused. Son was not even committing crimes, was just gating.

r- attacked. I even attacked him but he was not afk, so I spared him until he went grey to me.

I thought he gaurdwacked himself, and it still doesnt explain how he went grey to you. Calling him confused and talking about him saying wacky stuff looks like a transparent attempt to discredit him. I'm genuinely interested in how this came about. I sincerly hope that it's easily explainable. Last thing we need are people exploiting any unknown bugs.

How was it you were damaged, wasn't it because the afkers were auto-defending?
And yes, right now I am confused about how this happened.
I was waiting acting afk for you to attack me before I called guards, I was shocked to have them whack me instead.
I am not mad, but this isnt the first time I have been flagged grey for no apparent reason doing something completely different then here right now. GuardianKnight has had the same problem happen to him before as well, being flagged a criminal but under certain circumstances then the one in question but just as mysterious nonetheless.

Maybe its a lag issue with attacklast? I've attacked a guy before in brit gy, he recalled so I recalled and restocked; came back to brit bank prob 10 minutes later in which he shows up (we're both blue,) walks past me and I insta-hit -> gwhacked myself. Wasn't in war mode, either. =/ (had tabbed a few times.)
