Im almost positive that it was possible to trade off items that were recently stolen, and use your bank whyle grey. i know it was still around in UOR when i had my disarm thief.

You could not bank while grey in UO:R, and the recently stolen item timer very short anyway.

No banking while grey is accurate, and the message "You cannot trade recently stolen items" is as well- I remember stealing and dropping items on the ground to bypass this before I died. (so my friend could pick them up)

Items could be traded to another person upon theft up until the change noted in the February 23, 2000 patch notes, when stolen items along with trapped and moving of items in the trade window was forbidden. The patch can be found here.

Edit: As for banking while gray, there are patch notes from before T2A or just around T2A's release that note the barring of criminal banking being introduced. I'll find the specific patch some time today.
